HERE HABITS Terms & Conditions (EULA) – Effective Date: February 14, 2026
This End-User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User” or “you”) and Here Habits, LLC (“Company,” “we,” “us,” or “our”), a Delaware limited liability company, governing your use of the Here Habits mobile application (the “App”) and any related services, features, or content provided through the App (collectively, the “Service”). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with these terms, do not download, install, or use the App.
This Agreement is entered into between you and Here Habits, LLC only, and not with Apple Inc. (“Apple”). Here Habits, LLC is solely responsible for the App and its content. See all terms, license information, eligibility, limitations, features, subscription and payment details, user content, intellectual property, privacy, warranty disclaimers, liability limits, termination and dispute policies, Apple-specific terms, and contact information as provided below.
Key Terms & Conditions
1. Eligibility: You must be at least 13 years old to use the App. If you are between 13 and 18 or the legal majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or guardian. By allowing a minor to use the App, you accept these terms on their behalf.
2. License Grant: Subject to compliance with this Agreement, you receive a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device as permitted by Apple Media Services Terms and Conditions. You may not copy, modify, or reverse-engineer the App, use it unlawfully, or develop competing offerings with it.
3. Account Registration: Use of certain features requires account creation (Apple ID, Google Sign In, or email authentication). You are responsible for keeping credentials secure and notifying us of any breaches. Premium subscription features are available through In-App Purchases with a 3-day free trial for new users. All payments and renewals are handled via Apple.
Features, User Content & Privacy
4. Screen Time & Device Management: The App features Apple’s Screen Time frameworks for session management. These features require explicit permission and may restrict access to apps and websites temporarily. They are intended to aid personal productivity. We are not responsible for loss of access to devices or data.
5. User Content & Social Features: You keep ownership of your content but grant us a license to use/store/process it as needed to provide and improve the Service. Social features allow display name and email visibility to friends, and you may manage friendships or block users at any time. Harassment or misuse is not tolerated.
6. Intellectual Property & Privacy: The App and all related IP belong to Here Habits, LLC. All content is protected by law. Our Privacy Policy describes information handling and is available at https://herehabits.com/privacy.
Warranties, Liability & Legal
7. Disclaimer: The App is provided “as is” without warranties. It is not a medical device.—for informational/motivational purposes only. Consult a professional before making medical or health decisions based on the App.
8. Limitation of Liability: To the fullest extent permitted by law, Here Habits, LLC is not responsible for indirect, incidental, special, or consequential damages. Total liability will not exceed what you paid in the past 12 months or $50, whichever is greater.
9. Indemnification & Termination: You agree to indemnify Here Habits, LLC from all claims/damages arising from use or breach. You may delete your account at any time; some minimal information may be retained for account recovery and billing. Subscriptions must be cancelled in Apple ID settings.
Third-Party, Apple Terms, Governing Law
10. Third-Party Services: The App may use services like Firebase, RevenueCat, and Adjust and your usage is subject to their terms. We are not responsible for their practices.
11. Apple-Specific Terms: Apple has no obligation for support or warranty regarding the App. All claims or disputes about the App, including IP or legal issues, are the responsibility of Here Habits, LLC.
12. Governing Law, Changes & Communication: This Agreement is governed by Delaware law; disputes are resolved in Delaware courts. We may update terms at any time and will notify you via updates in the App or website.
